TERMS AND CONDITIONS OF USE OF THE INTERNET ACCESS DIALER
IMPORTANT:

The following terms and conditions (these "Conditions") govern the use of the Provider's proprietary Internet access dialer in order to access paid content or services, as well as the components described below. Any person using or installing the dialer (the "Software") or any of its components on any computer or equipment capable of storing it (a "Computer"), and/or who accesses the service by clicking on the "Click here to enter" button (a "User") thereby indicates that they understand and agree to these Conditions and consent to the downloading of the Software and its components on their Computer.

SPECIAL NOTICE

It has been detected that certain companies have been installing ".dll" files in Users' Computers, which block Users' access to certain web pages. Installing the Software will also install an ".exe" file which has the function of verifying whether the User's Computer contains such .dll files (which are unnecessary and harmful) and then deleting them.
A. GENERAL

1. The Software is designed to permit the User to access pay-per-view content, which may include adult content. USE OF THE SOFTWARE TO ACCESS ADULT CONTENT OR SERVICES IS STRICTLY PROHIBITED TO ANYONE UNDER 18 YEARS OF AGE (OR IF HIGHER THE LEGAL AGE TO ACCESS SUCH CONTENT IN THE PLACE OF CONNECTION), unless the law of the place of connection permits minors to access such content. In order to access such content the User must be, and hereby warrants that he or she is, at least such legal age. In addition, the User warrants that he or she will not distribute any such content accessed using the Software to any person under such legal age and will ensure that such persons do not gain access to such content from the User's Computer. In any case, if access to or use of any particular content, whether for adults or otherwise, is prohibited in the User's location of connection, the User must not use the Software or the service to access such content. The User agrees to use this service only in compliance with these Conditions and applicable law, being solely liable for any breach thereof.
2. Access to content and services using the Software is completely anonymous and does not require the provision of any personal data nor any credit card number or any other information. As set out below, components within the Software will obtain certain data with the aim of ensuring and improving access to the service, but at all times the service will remain anonymous. Access to certain content or services may require the completion of a registration form for the attribution of a username and password. At no time will any personal data be required for such registration and the provision of real personal data during the use of or the connection set up by the Software is prohibited. The User acknowledges that he or she is aware of the risks of revealing personal data, and accordingly the communication of any such personal data in the context of the use of the Software or the services takes place at the User's sole risk.
3. When the User runs the Software, the User's Computer will terminate its connection to the User's usual Internet service provider. The User's modem will then dial an INTERNATIONAL TELEPHONE NUMBER ("Access Number") and establish a connection, which will be billed to the relevant telephone bill at an additional cost to the basic telephony service and which will have to be paid by the party responsible for the line. The service carries no further cost. Depending on the User's location, the party responsible for the line may be entitled to request, and the relevant telephone service provider may be obliged to ensure, that the line is disabled from connecting to international telephone numbers). THE PROVIDER EXCLUDES ALL RESPONSIBILITY FOR ANY FAILURE BY SUCH TELEPHONE SERVICE PROVIDER TO EXCLUDE A USER'S NUMBER FROM SUCH INTERNATIONAL TELEPHONE NUMBERS.
4. The Software may permit access to content and/or services which may be supplied or published by the Provider or on its behalf. In cases where the User uses the Software to access content and/or services not supplied or published by the Provider or on its behalf, the User acknowledges that the provider of such content and/or services is the person that has supplied or published them.
5. The User hereby warrants that he or she is aware of the costs of accessing the service via a INTERNATIONAL TELEPHONE NUMBER from Congo - DR (243).
The Provider recommends that the User should instruct his or her telephone service provider to provide itemized billing for these calls. The User must always ensure that he or she is using this service with the express consent of the person responsible for paying for the telephone line, if this is not the User.
6. Once connected to the service, the User's Computer's modem will remain connected to the International Telephone Number unless and until:

a)    the User terminates the connection by selecting the connection symbol, located on the lower right side of the Windows task bar, and then clicking on the "DISCONNECT" button;

b) the User clicks on the "DISCONNECT" button which appears when the Software is executed;

c) the User terminates the Software or disconnects or switches off the User's modem or Computer;

d) in some cases, after 60 minutes of connection, the Software will automatically terminate the connection.

Please note that the User may be able to connect to non-premium Internet services using the Software. However, while the User is connected using the Software, the relevant telephone account will continue to be billed at the rates indicated until the User disconnects, even after leaving the services area. THE PROVIDER RECOMMENDS THAT THE USER SHOULD USE HIS OR HER NORMAL INTERNET ACCESS METHOD TO ACCESS FREE INTERNET CONTENT.

B PRODUCT

1. THE SOFTWARE AND ITS COMPONENTS ARE FULLY COMPATIBLE WITH POPULAR INTERNET BASED SCREENING SOFTWARE SUCH AS NETNANNY AND SURFWATCH. THESE ALLOW THE USER TO CONFIGURE HIS OR HER INTERNET BROWSER SO THAT IT FILTERS OR PREVENTS ACCESS TO CERTAIN CONTENT. USERS SHOULD CONSULT THE HELP MANUAL OF THEIR BROWSER FOR MORE INFORMATION ON THIS POINT.
2. The Software includes a component which will remain active at all times with the objective of verifying and ensuring the correct functioning of the Software and optimizing the User's access to the Provider's services and/or content, and offering other advantages. For this purpose, when the User is connected to the Internet the component will make periodic connections to the Provider's servers in order to check that there are no problems in the access network or the User's Computer. If any error which prevents access to the Provider's services is detected in the User's Computer, the component will seek to identify and solve it. If the problem is due to a conflict with any other program in the User's Computer that is clearly unnecessary, the component will seek to resolve it by adapting the service or deactivating such program, provided always that this does not prejudice or inconvenience the User. Any changes that the component makes to the User's Computer will be to clearly non-essential parts thereof and for the purposes referred to in these Conditions. THE USER REQUESTS AND AUTHORIZES THE INSTALLATION AND UPDATING OF THIS COMPONENT TOGETHER WITH THE SOFTWARE IN ACCORDANCE WITH THE TERMS SET OUT IN THESE CONDITIONS. The component will carry out the tasks described in these Conditions only when the User is connected to the Internet, whether using the Software or the User's regular Internet connection. In any case, the User can easily uninstall the Software or the component by selecting "Access Connection" and "Component Add-On" respectively in the appropriate section of the operating system control panel. Users should be aware that upon such uninstallation, the benefits provided by the component will not be available and in certain cases the Software (if retained) or the Provider's services may not function correctly.
3. One of the advantages which the component provides to the User, and which allows the Provider to improve the quality of the services, is the ability to show on the User's Computer advertising messages or other information from the Provider or third parties with whom the Provider has concluded relevant agreements, for the purposes of explaining the Provider's services and their correct use, or such other services, promotions and offers that may interest the User on the basis of the User's internet use (e.g., web pages visited, keywords used in search engines). The User authorizes the showing of these messages, which will be stored in the User's Computer and will be shown while the User is connected to the Internet. Advertising messages will be easily identifiable and will not interfere with the other content viewed by the User or the performance of the User's Computer.
4. In order to carry out the operations referred to in the paragraphs above, the component will send certain data from the User's Computer to, and will receive information and requests for these purposes from, the Provider's servers. The data sent to the Provider's servers by the component will be limited to technical and connection information such as: operating system user name, name of the computer in the operating system, IP address of the LAN of the computer, country of connection, browser default country, operating system version, operating system or browser service packs installed, ID of the most recent browser update, vertical and horizontal resolution of the monitor screen, IP address of the most recent internet connection, maximum and average response times, percentage losses, name of the last RAS connection and others relevant for the purposes indicated. The User authorizes such exchanges of information with the Provider's servers in accordance with these conditions. At no time will any information regarding Internet sites visited or other activities of the User be sent to the Provider's servers; this information will be processed within the User's Computer in order anonymously to select advertising or other messages to be shown to the User. In no case will the Provider be able to identify the User nor will any profile of the User be created.
